Meanwhile sister Lindsay isn't helping her case after a magazine claimed today that she was drinking when she tweeted her confession.

In her confessional posting on Twitter Lindsay said: 'I'm taking responsibility for my actions and am prepared to face the consequences'.

But according to Us Weekly magazine a witness saw the star compose her statement that night on her Blackberry while at Hollywood restaurant Magnolia.

It's claimed Lindsay laughed and drank alcoholic drinks as she typed.

Lohan was with her assistant and a male friend who apparently were coaching her on how to make it 'more personal'.

The witness reported: 'Her friend would say, 'No, use setback, don't say mistake. They'll say you make mistakes all the time!'

Continuing, the friend said: 'It's better to say you're responsible. Denying it will just get everyone mad per usual'.

The source said Lindsay responded by 'giggling' and had her assistant order her another Jack Daniels and Coke.

Lindsay is due back in court tomorrow to answer to charges she broke her probation by testing positive for cocaine.

Judge Elden Fox could schedule a formal probation revocation hearing 30 days from tomorrow.

If Judge Fox decides to go that route he could order Lindsay to go to jail immediately and stay there until the formal hearing.

However, if she is sentenced to 30 days on Friday she could end up serving no time at all due to jail overcrowding.
